It is amazing how the word “fairness” is used. It differs from each person. What one may think is fair someone else may think it is the opposite.  Two cases really brought out the point that fairness is really not fair.

“But this is important: the fact that I settled is not an admission of guilt. My lawyers and I firmly believe that the pixel art is “fair use” and Maisel and his counsel firmly disagree. I settled for one reason: this was the least expensive option available(Andy Baio).”

This quote  comes from an artist who created a pixulated form of an album cover. He settled because it was the cheapest option for him to do. I agree with his decision even though in the copyright laws concerning “fair use” he did no wrong. Sometimes its better and cheaper to just take the bullet.

 

The second case dealt with an artist’s alteration to a picture. Richard Prince was sued for copyright infringement.  From his view, Prince believed that he had made enough alterations to the picture for it to be considered as fair used. However the original photographer begged to differ.

These two cases proves that “fair use” in my opinion does not exist. Not all cases are the same but these cases proves that everyone takes a different view point on the term “fair use”
